TERMS AND CONDITIONS OF TRADING
(Consumer Contract Version)
These Terms and Conditions apply to all quotations, sales, supply of goods, and installation services provided by Timbercraft Customwood Ltd. These Terms do not affect your statutory rights.
By approving your design and paying a deposit, you agree to these Terms and Conditions.
1. Definitions
1.1 “Company” means Timbercraft Customwood Ltd.
1.2 “Customer” means the person entering into the Contract for private residential purposes.
1.3 “Goods” means furniture, cabinetry, appliances and related items supplied.
1.4 “Services” means design, survey, delivery and installation services.
1.5 “Contract” means the agreement formed when the Customer approves the quotation and pays the deposit.
2. Quotations
2.1 Quotations are valid for 14 days unless otherwise stated.
2.2 Prices may change prior to order confirmation due to supplier increases, exchange rate movements or specification changes.
2.3 Quotations are based on information available at design stage.
2.4 Clerical or typographical errors may be corrected.
2.5 Where a quotation is prepared based on measurements, drawings or information supplied by the Customer or third parties, the quotation is strictly subject to formal site survey and verification by Timbercraft.
2.6 If dimensions, structural conditions, service positions or site details differ from those initially provided, the Company reserves the right to revise the quotation accordingly.
2.7 Any revised quotation will be issued to the Customer for approval prior to order confirmation.
3. Orders and Deposits
3.1 An order is confirmed upon written approval and receipt of deposit.
3.2 The deposit secures manufacturing capacity and design allocation.
3.3 Payment of the deposit forms a binding Contract.
4. Bespoke Furniture and Cancellation
4.1 All Timbercraft furniture is manufactured to order and made specifically to the Customer’s approved design and dimensions.
4.2 Bespoke goods made to the Customer’s specification are exempt from statutory cancellation rights once manufacturing has commenced.
4.3 If cancellation occurs before manufacturing has commenced, Timbercraft will retain the deposit to cover reasonable costs incurred, including design services, technical drawings, site surveys and administration.
4.4 If cancellation occurs after manufacturing has commenced or supplier components have been ordered, the Customer shall be responsible for costs reasonably incurred by Timbercraft, which may include the full contract value where materials have been committed and cannot be reused.
4.5 Timbercraft will provide a breakdown of reasonable losses upon request.
4.6 Appliances and special order items may be subject to individual supplier cancellation terms.
5. Payment Terms
5.1 Payment stages are as outlined in the quotation.
5.2 Unless otherwise agreed in writing, the balance is payable prior to delivery or installation.
5.3 Title to goods remains with Timbercraft until payment is received in full.
6. Late Payment
6.1 If payment is not made by the due date, Timbercraft may suspend delivery or installation until payment is received.
6.2 Interest may be charged on overdue sums at a reasonable rate not exceeding statutory limits, calculated from the due date until payment.
6.3 Timbercraft may recover reasonable costs incurred in recovering overdue amounts where legally permitted.
7. Site Preparation
7.1 The Customer must ensure the site is ready for installation, including:
- Floors laid and level
- Walls plastered and finished
- Electrical and plumbing first fix completed
- Services positioned in accordance with approved drawings
- Safe and clear access
7.2 If the site is not ready on the agreed installation date, installation may be rescheduled and reasonable additional costs may apply.
8. Measurements and Drawings
8.1 Designs are based on measurements taken during survey.
8.2 The Customer is responsible for ensuring building works align with approved drawings.
8.3 Electrical layouts must be agreed prior to ordering.
9. Delivery
9.1 Delivery dates are estimates only.
9.2 Timbercraft is not responsible for delays outside its reasonable control.
9.3 Risk in goods passes to the Customer upon delivery to site.
10. Installation and Completion
10.1 Installation dates are subject to site readiness and material availability.
10.2 A completion report will be issued within 24 hours of installation completion.
10.3 The Customer should inspect the installation promptly and notify Timbercraft of any visible issues within 7 days.
10.4 This does not affect the Customer’s statutory rights in respect of defects.
11. Defects and Remedial Works
11.1 In the unlikely event of a defect, Timbercraft will repair or replace defective items within a reasonable timeframe.
11.2 Where replacement materials are sourced internationally, lead times may apply.
11.3 Timbercraft is not responsible for defects arising from misuse, unauthorised modification or third party interference.
12. Appliances
12.1 Appliances supplied by Timbercraft are covered by manufacturer warranties.
12.2 Timbercraft is not responsible for defects arising from incorrect installation by third parties.
13. Natural Materials
13.1 Timber, veneers and stone are natural materials and may vary in colour and grain.
13.2 Such variations are not defects.
14. Limitation of Liability
14.1 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
14.2 Timbercraft’s liability for other losses shall be limited to the contract value.
14.3 Timbercraft is not liable for indirect or consequential losses where legally permissible.
15. Force Majeure
Timbercraft shall not be liable for delay or failure caused by events outside its reasonable control.
16. Storage
If goods are ready and installation is delayed due to site readiness, reasonable storage charges may apply.
17. Photographs
Timbercraft may photograph completed installations for marketing purposes. No personal data will be published without consent.
18. Governing Law
These Terms and Conditions are governed by the laws of Ireland.
